Terms of Use

1Acceptance and Eligibility

You must be at least 18 years old and have authority to bind the business you represent to use the Services. If you do not agree to these Terms, do not access or use the Services.

2Description of the Services

Face Age provides AI-powered facial and skin analysis technology delivered through: (a) a Panel for account and API-key management; (b) a REST API and Laravel-based backend; (c) a JavaScript SDK for embedding the analysis widget on a Customer's website; and (d) a Shopify application providing equivalent functionality within the Shopify platform. Face Age may update, modify, or discontinue features of the Services from time to time.

3Accounts and API Access

• You are responsible for maintaining the confidentiality of your account credentials, API keys, and access tokens, and for all activity that occurs under them.
• You must notify us promptly at [email protected] if you suspect unauthorized use of your account or credentials.
• We may suspend or revoke API access that we reasonably believe is being used in violation of these Terms or in a manner that threatens the security or availability of the Services.

4License

Subject to your compliance with these Terms and payment of applicable fees, Face Age grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Panel, API, SDK, and Shopify application solely to integrate AI skin/face analysis into your own website, application, or storefront for your end customers. You may not resell, sublicense, reverse-engineer, or use the Services to build a competing product.

5Customer (Business/Merchant) Responsibilities

As the operator of the website or storefront on which the Services are embedded, and as the data controller for your end customers' personal data, you agree to:

• Obtain valid, informed, explicit consent from each end customer before the camera or photo-upload feature activates, and before any biometric or health-adjacent data is processed, in accordance with applicable data protection law;
• Maintain a privacy notice on your own website or storefront that accurately describes your use of the Services, incorporating or linking to our Privacy Policy as appropriate;
• Configure and operate any cookie-consent or advertising-consent banner required for analytics or advertising integrations (such as Google Analytics/Tag Manager or the Meta Pixel) that you choose to enable;
• Only request scopes, data fields, and integrations that are necessary for your intended use of the Services (data minimization);
• Promptly relay any data subject request you receive from your own customers to Face Age where it concerns data we hold on your behalf, and cooperate with us to fulfil it within the applicable statutory timeframe;
• Not use the Services to process data belonging to children below the applicable minimum age without the parental consent mechanisms required by law.

6Fees, Billing, and Trials

Fees for paid plans are described on our pricing page or in your order form, and are billed via Stripe or PayPal on a subscription basis. Fees are non-refundable except as required by law or as separately agreed in writing. If you do not pay applicable fees when due, we may suspend or terminate your access to the Services. Trial periods, where offered, convert to a paid subscription unless cancelled before the trial ends.

7Data Protection

Our respective data protection obligations, including the categories of data processed, sub-processors used, and security measures applied, are described in our Privacy Policy and, for business customers requiring one, in a separate Data Processing Agreement available on request. You represent that you have, and will maintain, a valid legal basis for any personal data you submit to the Services or authorize us to collect on your behalf.

8Intellectual Property

Face Age and its licensors retain all right, title, and interest in the Services, including the underlying software, models, and documentation. You retain all rights in the content, product data, and customer data you submit to the Services. You grant Face Age a limited license to process that content solely to provide the Services to you.

9Acceptable Use

You will not, and will not permit others to: (a) use the Services to violate any law or third-party right, including data protection law; (b) attempt to gain unauthorized access to the Services or any related systems; (c) interfere with or disrupt the integrity or performance of the Services; (d) submit content you do not have the right to submit; or (e) use the Services to process special-category data of an individual without the required consent.

10Third-Party Services

The Services integrate with, or allow you to connect, third-party services such as Shopify, Stripe, PayPal, OpenAI, Klaviyo, Omnisend, Mailchimp, HubSpot, ReCharge, Google, and Meta. Your use of those integrations is also governed by the applicable third party's own terms and privacy notice. Face Age is not responsible for the acts or omissions of independent third-party providers.

11Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." YOU AGREE TO USE THE SERVICES AT YOUR OWN RISK. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING AS TO THE ACCURACY OR COMPLETENESS OF ANY CONTENT, ANALYSIS RESULT, OR RECOMMENDATION. FACE AGE'S SKIN AND FACE ANALYSIS IS PROVIDED FOR INFORMATIONAL AND COSMETIC-RECOMMENDATION PURPOSES ONLY AND IS NOT MEDICAL ADVICE, A MEDICAL DEVICE, OR A DIAGNOSTIC TOOL. WE DO NOT ENDORSE THIRD-PARTY PRODUCTS OR SERVICES AND ARE NOT RESPONSIBLE FOR ANY TRANSACTION BETWEEN YOU, YOUR CUSTOMERS, AND THIRD PARTIES.

12Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACE AGE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FACE AGE'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE FEES YOU PAID TO FACE AGE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13Indemnification

You agree to indemnify and hold Face Age harmless from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of applicable law, or your failure to obtain required consents from your end customers.

14Term and Termination

These Terms remain in effect while you use the Services. Either party may terminate for convenience with notice as specified in your order form, or immediately for material breach that is not cured within 14 days of notice. Upon termination, your license to use the Services ends, and we will handle your data as described in the "How Long We Keep Your Information" section of our Privacy Policy.

15Changes to These Terms

We may update these Terms from time to time. Material changes will be notified as described in the "Changes to This Notice" section of our Privacy Policy. Continued use of the Services after changes take effect constitutes acceptance.

16Governing Law

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles, unless a mandatory local consumer-protection or data-protection law requires otherwise for a specific data subject.
